Turkey's KVKK Article 11: data subject rights

Article 11 of the KVKK gives anyone whose data is processed the right to ask the controller for information, correction, erasure and compensation.

The rights

Anyone may apply to the controller to:

  • learn whether their personal data are processed and request information about it,
  • learn the purpose and whether data are used accordingly,
  • know the third parties in Turkey or abroad to whom data were transferred,
  • request correction of incomplete or inaccurate data,
  • request erasure or destruction under Article 7,
  • request that corrections and erasures be notified to third-party recipients,
  • object to an adverse result from exclusively automated analysis,
  • claim compensation for damage caused by unlawful processing.

Most used in practice

For content removal, erasure and notification of recipients are used together, so that sites copying the same content are also told. The right to information helps identify the source.

How to use them

By written application to the controller; procedure under Article 13.

Frequently asked questions

Can I use these rights against a site outside Turkey?

You can apply, but enforcement is hard; for European sites the GDPR, and for others platform rules, work better.
