Turkey's KVKK Article 14: complaint to the Board

If a controller refuses, answers inadequately or ignores your request, Article 14 lets you complain to Turkey's Personal Data Protection Board within short deadlines.

What it says

After a refusal, an inadequate answer or no answer in time, the data subject may complain to the Board within thirty days of learning the controller's answer, and in any case within sixty days of the application. You cannot complain without first applying to the controller.

Compensation is preserved

The right to claim compensation under general law for violations of personality rights remains, so a Board complaint does not bar a court claim.

What the Board can do

It examines the complaint, can order the controller to remedy unlawful processing and can impose administrative fines; in practice this can take months. Template: complaint to the KVKK Board.

Frequently asked questions

Board or court first?

If content must come down fast, courts and platform routes are usually quicker; the Board is effective for changing a controller's behaviour.
